When SM00VE, sm00ve.com or Team SM00VE are mentioned as legal entities on this site, we are actually talking about Smooth It Out, Inc. We're referring to it here as SM00VE to avoid confusion. And you are you, reading this now. Even if you're a robot, in which case we're referring to the guys that created you, own you, or on whose behalf you are running.
If you are going to use SM00VE, then make sure you read, study, and understand the small print of the terms and conditions below.
License to Use SM00VESM00VE grants you a limited license to access the site, so long as you follow the rules of our universe, which we list here. We can terminate this license whenever we want, for whatever reason we want, without even telling you we are doing so, and we can charge to use the site one day. In short, if you're smooth with us, we'll be smooth with you.
Participant ResponsibilityYou are responsible for your use of the site, so take responsibility for your actions. Since SM00VE stores, displays, and shares appropriately information that you--and the other participants in a deal--input to it, SM00VE cannot support, endorse, or agree with any deals, information, data, opinions, beliefs, or advice posted to or agreed to on SM00VE, nor can SM00VE vouch for the accuracy of any statement made on SM00VE. We don't take sides. Similarly, if you upload any images or content to SM00VE, this content is your responsibility, and if you include a link to an outside site, it is still your responsibility and we still have nothing to do with that.
It is also your responsibility to not abuse the system, such as by trying to use it to send spam, or posting information you don't have permission to post.
Prurient ContentSince SM00VE users can post any content to a deal in which they are participants, a participant in a deal might be exposed to language--written by a participant with whom they are participating in a deal--that is vulgar, raw, lewd, beastly, lascivious, prurient, incontinent, lecherous, sultry, concupiscent, libidinous, miasmic, obscene, sexual, or otherwise offensive to you or wildly inappropriate by your or any standards. Use SM00VE at your own risk. If you do not approve of the content of the site, you agree that the only thing you will then do will be to stop using the site immediately.
Limitation of LiabilitySM00VE provides the site "as is" and without any warranty or condition. SM00VE disclaims, in particular, any implied warranties of information accuracy, merchantability, non-infringement, or, especially, quiet enjoyment.
If any problems or danger arise from your use of SM00VE, only you will be responsible for it. You take responsibility for your own actions and use SM00VE at your own risk. SM00VE will not be liable for any direct, indirect, consequential, incidental, special, or punitive damages. This includes damages incurred through the non-performance of the site, or the software functioning or malfunctioning--and the resulting loss of sales, data, goodwill, or profits, whether or not SM00VE had already been advised of the situation.
If you live in a state or country where this exclusion of liability of incidental or consequential damages is not allowed, then just ignore that part, but not the rest of this document.
Trademarks and CopyrightsSM00VE, our logo, and our design are trademarks of SM00VE, and may not be used without the written permission of SM00VE, other than linking to or promoting SM00VE. All other trademarks that may appear on SM00VE are the property of their owners. The SM00VE software and content of the site are owned by SM00VE, too. And we will soon have a pending patent.
ChangesThis policy may change occasionally and we may not tell you that it was updated. So check back regularly to make sure it hasn't changed. In most cases, the changes will be minor, and if any changes are significant, we will point them out. This page will also list the date this policy was approved.
JurisdictionThese terms are also governed by the laws of New York State. And even if some of these terms are illegal in the relevant jurisdiction or unenforceable, the rest will be still be valid.
