SM00VE Privacy Policy

Team SM00VE is a bit obsessed with privacy; we take it very seriously. We respect the privacy of our users and do everything we can to protect it. This privacy policy explains how we do so.

Because SM00VE is intended to encourage communication between users who know each other in a private manner, we want to make clear what information we will share with third parties, and what information users are sharing among other users.

SM00VE and sm00ve.com are owned by Smooth It Out, Inc., a New York corporation. When SM00VE, sm00ve.com or Team SM00VE are mentioned as legal entities on this site, we are actually talking about Smooth It Out, Inc. We're referring to it here as SM00VE to avoid confusion. And you are you, reading this now. Even if you're a robot, in which case we're referring to the guys that created you, own you, or on whose behalf you are running.

Information we have about you

When you register as a SM00VE user or someone invites you to SM00VE, you--or the person who invited you to SM00VE--give us some information about yourself. This includes, a name you call yourself or someone else calls you (this could be a first name or a nickname, and does not need to correspond to your legal name); your email address; your gender; and, sometimes, if registered by someone else, your relationship with the other user.

SM00VE also knows the content of deals--that is, any information you've input into the site during a deal, or that any other user in a deal with you has input into the site during a deal with you. This includes, text of the deals, images uploaded, text of the comments made on the deal, and other such information. All of this information is associated with your user account.

SM00VE also captures information for web analytics that is made available by your web browser, servers, and Internet Service Providers. This information includes things like, the referrer site that sent you to SM00VE, your browser type, the timestamp of each visitor request, and mouse movements on each page. We might publicly release aggregate non-personally identifying information about site usage, that has no way to be traced back to individual users, such as what browsers are used in aggregate by our users.

Information sharing

Deals themselves are private among the participants. SM00VE shares information about you only with users with whom you participate in deals. The participants in a deal include anyone you invite into that deal (such as the person you began the deal with, or the witness you added) or anyone that any other participant invited into that deal. Participants who are not actively negotiating, such as witnesses, can still read and follow the entire deal.

With these participants in a deal with you, SM00VE shares only your email address; under certain circumstances, the name you have given yourself; and, if you have designated it, your relationship with the other users; and the content of the deal. All of the content of the deal is shared with all the participants, including witnesses, including: what deals are proposed to these participants, what deals are agreed to by these participants, all comments made on the deal by these participants, all infractions logged by these participants, all deals renegotiated by these participants, all deals terminated by these participants, among other information.

No information about any deal will be shared with any user, visitor, or robot who is not a participant of that deal. Any user of SM00VE or the public web site of SM00VE cannot access any information about you, your deals, or any content you've uploaded to SM00VE. If another user is participating in a deal with you, he cannot see any information about other deals you are participating in, in which he is not a participant.

We will share information about you and deals you have been involved in with other entities like government authorities and courts, if we need to comply with any laws, regulations, or legal processes; to detect, prevent, or limit fraud or security issues; or protect ourselves against imminent harm to ourselves, our site, or our property.

Information security

We take appropriate measures to protect your data from any unauthorized access, alteration, or destruction. We protect your information by doing various things, including: regularly backing up our databases and content to multiple servers, confirming all email addresses before we send emails on behalf of a user, and using secure sockets layer user authentication and login.

We also restrict who, within our company and partners, can see the data in our databases and servers. Employees and contractors have limited access to the data. Certain employees have access to greater amounts of information, such as our sysadmins who run the physical servers. All employees are bound by confidentiality agreements and will be punished--including job termination and possibly criminal prosecution--if they don't live up to these obligations. All employees and contractors who have access to any sort of user information have additionally agreed to deals in SM00VE in which they acknowledge that they are under an obligation not to reveal any information to anyone else, and if they are to violate this, then--in addition to pursuing legal action--infractions will be logged against them in SM00VE.

Cookies

SM00VE may store a cookie on the computer you are using, associating that browser you're using with your SM00VE account. This cookie might still associate your user with that computer, even after you close your browser. Your browser must be configured to accept cookies in order to use SM00VE. Any user can configure his browser to not accept cookies; in this case, he must also choose to not access SM00VE. Whenever a user changes computers or wishes to remove SM00VE-related cookies from his browser, he should use the "logout" functionality that is available to every logged-in user on every page in SM00VE.

Uses of your Information

When you initiate or participate in a deal on SM00VE, emails may be sent to the other participants in that deal, with the information you provided in that deal. In certain cases, your name and email address may be used when contacting other participants in the deal, with information about your deal.

SM00VE systems may also process personal information for purposes such as: sending you relevant information about SM00VE; analytics about SM00VE usage; to detect fraud or abuse; to ensure the technology of the site is functioning smoothly; to help develop new services.

SM00VE's servers are located inside the United States of America. If you are accessing the site from any other country, you will have your information transferred to the United States. Do not use SM00VE if you do not have the right to transfer this information to the jurisdiction of the United States.

Emails

SM00VE may send you emails, at the email address you provided, to update you on your activity and deals in SM00VE, and the activity of other participants in deals with you in SM00VE. We might also email you to respond to questions you ask us, to contact users about improving our service, or send you information about SM00VE, your usage of SM00VE, and our services.

Linked web sites

SM00VE is not responsible for any privacy issues on any web sites other than sm00ve.com and other web sites owned by Smooth It Out, Inc. If another web site is linked to from SM00VE, you should read that site's privacy policy and only use that site if you are unequivocally sure you agree with it.

Updating personal information

Currently, if you are a user and you wish to update your name within the software, you can do so at any point using the software. If you wish to update your email address, you should contact us via and we will correspond with you, confirm your email address, and then update it in the database ourselves. In the future, we will probably provide functionality to allow users to automatically update their own email addresses.

Deleting your account

If you wish to terminate your account, you can contact us at . We might contact you to confirm you want your account deleted. If you terminate your account, you will be removed from the publicly-accessible site, and you will no longer be able to access SM00VE, but all of your previous information will still be stored on our servers and backup systems. Your former user, and all of the data associated with it that is viewable by other participants, will still be listed at the appropriate points on all the appropriate deals. Similarly, information about your former user and deals may still be available to participants of deals you have made. Users in the future may re-invite you to SM00VE and begin deals with you anew, even if you don't have an account. You have the option to not participate in any deals you are invited to.

Enforcement

SM00VE regularly reviews our own compliance with this policy. If you have any questions or concerns, contact us at the address below, and we will investigate your concerns and get back to you as soon as we can. We also cooperate with any regulatory and other authorities to resolve any complaints.

Changes

This policy may change occasionally and we may not tell you that it was updated. So check back regularly to make sure it hasn't changed. In most cases, the changes will be minor, and if any changes are significant, we will point them out. This page will also list the date this policy was approved.

Jurisdiction

These terms are also governed by the laws of New York State. And even if some of these terms are illegal in the relevant jurisdiction or unenforceable, the rest will be still be valid.
